資安政策與服務條款

1. 政策目的
中央研究物理所高能物理與科學計算技術中心(以下簡稱本中心)為推動資訊安全、雲端安全管理系統,建立安全及可信賴之資訊作業環境,確保資料、系統、設備及網路安全,特訂定「資訊安全政策」(以下簡稱本政策),以確保資訊安全、雲端安全及提升服務品質。
2. 適用範圍
所有本中心之同仁、合作夥伴、外部方(如行政機關、供應商等)等,皆有責任遵循本政策。
3. 本中心所有同仁、外部方人員謹記:宣導標語:「資通安全,人人有責」。
4. 資安政策及資安目標
4.1 資訊安全管理與法規
4.1.1 本中心同仁均須簽署「中央研究院聘(僱)人員契約書」,外部方參加本中心專案人員均須簽署「外部方切結書」,並遵守「國家機密保護法」、「營業秘密法」、「個人資料保護法」、「著作權法」、「刑法」、「資通安全管理法」、「資通安全管理法施行細則」及資通安全管理法子法等國家相關法規之要求,且不得發生洩密或違法事件。
4.1.2 辦理本中心受託業務之第三方,其相關程序及環境應具備完善之資通安全管理措施或通過第三方驗證。第三方辦理受託業務其複委託之範圍與對象,及複委託亦應具備資通安全維護措施。
4.2 委製、共同合作或專案資料之存取或異動
專案檔案均應設置存取權限,敏感(機密)資訊傳輸前必須先行加密。
4.3 雲端服務安全管理
4.3.1 因應雲端服務之資訊安全風險,依照 ISO 27001 及 ISO 27017 之資安要求,設計、建置與提供雲端服務,並做好風險管理。
4.3.2 所有雲端服務設計、規劃、建置、運維等相關內部人員,皆於任用時即簽署告知應負的法律責任與義務。
4.3.3 相關內部人員均了解並簽署保密切結文件,以對機密性或敏感性資料的控管。
4.3.4 內部人員對相關系統資訊存取,以最小權限、最少資訊為原則,並以帳號申請與角色分類控管權限。
4.3.5 雲端平台運維人員僅限定特定人員可註冊申請平台系統存取權限。
4.3.6 雲端服務為多租戶平台,每一租戶皆可享有獨立虛擬化使用空間,於部署 VM 服務和使用時,不與其他租戶間的服務資源互相影響。
4.3.7 雲端服務如需進行平台優化、異動調整等可能影響服務時,將主動提前通知用戶。
4.3.8 雲端服務進行變更管理時,由專人處理雲端服務任何相關問題。
4.3.9 雲端服務需透過 SSH 或 VPN 加密連線至 VM 進行管理,以確保連線安全。
4.3.10 落實雲端服務帳戶的生命週期管理。
4.3.11 雲端平台提供申裝資源的新增、異動、退租等所有操作時間歷史紀錄。
4.3.12 本雲服務提供商位於臺灣,可以儲存及保護雲服務客戶資料。
4.3.13 溝通違規行為與資訊共享,以協助調查與取證。
4.4 資訊安全目標及量測
4.4.1 機密性目標及量測指標:每年進行統計遭查獲洩漏機敏資料件數不得超過一件。
4.4.2 完整性目標及量測指標:每年進行統計回報資料遭竄改件數不得超過一件。
4.4.3 可用性目標及量測指標:每年進行統計連接院部主幹網路非預期中斷 48 小時件數不得超過二件。
4.4.4 適法性目標及量測指標:每年進行資訊安全管理制度作業檢驗,因違反「國家機密保護法」、「營業秘密法」、「個人資料保護法」、「著作權法」、「刑法」、「資通安全管理法」等國家相關法規件數不得超過二件。
5. 政策審查
5.1 本政策應至少每年評估審查一次,以符合政府相關法規之要求,並反映資訊科技之最新發展現況,確保資訊安全管理作業之有效性。
5.2 本政策須經管理委員會審查或管理代表核准,於公告日施行,並以書面、電子或其他方式通知所有同仁及合作廠商或單位遵守,修正時亦同。

本條款構成本中心與您(指您本人或您所代表之法人機構)間之契約。如您為法人或其他組織簽署本條款,即表示您已獲合法授權,且具簽署並使該法人或組織受本條款拘束之權限。
第一條 註冊帳號
(一)使用本服務前,應先完成註冊,並提供本人或代表單位之真實資料。
(二)計畫主持人(PI)須自行審核其所屬群組成員身分,並負責管理帳號。
(三)帳號不得轉讓、出借或授權他人使用。若經由使用者帳號所進行之操作造成損害,使用者須負全責。
(四)本中心有權視服務需要要求使用者進行身分驗證或補充資料,未配合者得限制其使用權限。
第二條 服務內容
本中心依實際營運狀況,提供包含但不限於高效能運算資源、儲存資源、資料處理服務、AI 訓練平台、使用者管理機制等。服務內容依本中心網站公告為準,並保留隨時新增、調整或終止各項服務內容之權利。
第三條 服務費用及付款方式
(一)除免費服務外,部分服務須依本中心公告或雙方合意另行簽署之合約繳納費用。
(二)付款方式、期限與幣別以報價單、合約或網站公告為準。
(三)若使用者未於期限內繳費,本中心得暫停其部分或全部服務,並有權終止契約。
(四)費用一經繳納,原則上不予退還,除非因本中心可歸責原因致服務無法提供。
(五)使用者若申請升級、擴充等服務,應依新服務內容補繳差額。
第四條 本服務使用規範
(一)使用者不得將本服務用於任何違反法令、侵害第三人權益、或妨害公共秩序與善良風俗之用途。
(二)禁止利用本服務進行攻擊行為(如 DDoS)、破解、惡意掃描、垃圾信、病毒傳播等行為。
(三)使用者有責任定期備份資料,並自行負責因資料遺失或毀損所生風險與損失。
(四)使用者應遵守相關法律及智慧財產權規定,不得於本服務中上傳、儲存、散布未經授權之著作。
(五)本中心有權視系統安全與資源管理需要,對異常行為、疑似濫用或違規行為進行記錄與處置。
(六)為維持整體系統穩定,本中心得進行必要之資源限制(如 CPU、記憶體、網路頻寬等)。
第五條 資料保存與隱私權
(一)本中心依《個人資料保護法》及相關規定保護使用者個資,詳情請參閱隱私權政策。
(二)使用者所處理或儲存之資料,其所有權與保密義務由使用者自負。
(三)本服務中所儲存之資料,僅限計畫主持人及被授權成員依其權限存取與操作,非經授權他人不得讀取或修改。
(四)本中心僅提供儲存空間與計算平台,不保證資料之正確性、完整性或可用性,使用者應自行備份重要資訊。
(五)本中心不保證資料永久保存,並得於服務終止後依公告期限清除資料,使用者應自行備份重要資訊。
(六)使用者於本服務所儲存之資料將保存在臺灣地區,並遵循相關法律及本中心之資安與隱私政策進行管理。
第六條 智慧財產權
(一)本中心提供之所有內容(包含但不限於系統架構、程式碼、圖像設計、標誌等)均受智慧財產權法保護,未經授權不得擅自使用。
(二)使用者於本服務所產出之成果,其智慧財產權歸原使用者所有。但若使用本中心技術人力、資源協助開發者,相關產出須依雙方簽署之合約或合作備忘錄另行約定智慧財產權歸屬。
(三)如使用者行為涉有侵權,本中心有權中止服務並依法追究損害賠償責任。
第七條 資安事件通報與責任
(一)使用者發現可疑資安事件(如資料外洩、異常連線、帳號盜用等)應即時通報本中心。
(二)使用者應積極配合本中心就資安事件進行調查、稽核及處理,並提供必要之紀錄與說明。
(三)若資安事件起因於使用者之疏失或違規行為,或經查證後確認應負責任者,使用者應承擔相關損害賠償與法律責任。
(四)本中心依照資安規範建置防護機制,但不對任何資安事件造成之資料損毀或服務中斷負最終保證責任。
第八條 服務中斷與免責條款
(一)本中心得基於下列情況中止全部或部分服務,且不負損害賠償責任:
- 系統維護、升級或異常排除所需;
- 第三方服務(如電信、電力)中斷;
- 不可抗力因素(如天災、戰爭、法令變動等);
- 使用者違反本條款或其他契約內容。
(二)對於因服務中斷或資料遺失所生之直接或間接損失,本中心不負賠償責任,但法律另有規定或合約另訂者除外。
第九條 契約終止與帳號移除
(一)使用者得隨時申請終止帳號或停止使用本服務。
(二)如使用者違反本服務條款,本中心得立即終止其服務權限,且無須退費。
(三)帳號終止後,本中心有權刪除該使用者所儲存之所有資料,恕不另行通知。
第十條 條款修改與服務調整
(一)本中心得不定期修訂本服務條款,修訂內容將於網站公告,不另行個別通知。
(二)使用者於條款修正後繼續使用本服務,即視為同意接受最新條款內容。
第十一條 SLA 優先權
如本服務另有服務等級協議(SLA),則該 SLA 條款於適用範圍內優先於本服務條款解釋。
第十二條 準據法與管轄法院
(一)本服務條款以中華民國法律為準據法。
(二)若發生訴訟,雙方同意以臺北地方法院為第一審管轄法院。

Welcome to the DiCOS Member Website and related services (hereinafter referred to as “the Services”) provided by Academia Sinica Grid Computing Center (hereinafter referred to as “the Center”). To protect your rights, please carefully read the following terms of registration and service use (hereinafter referred to as “the Terms”). By clicking “I Agree” online, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
These Terms constitute a contract between you (either as an individual or a legally authorized representative of an entity) and the Center. If you are accepting these Terms on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Article 1: Account Registration
You must complete registration before using the Services and provide truthful and accurate personal or organizational information.
The Principal Investigator (PI) is responsible for verifying the identity of their group members and managing their accounts.
Accounts may not be transferred, lent, or authorized for use by others. The user is fully responsible for all actions performed using their account.
The Center reserves the right to request identity verification or additional information; failure to comply may result in restricted access.
Article 2: Scope of Services
The Center provides, based on operational conditions, services including but not limited to high-performance computing resources, storage, data processing, AI training platforms, and user management mechanisms. The scope of services is subject to the announcements published on the Center’s website. The Center reserves the right to add, adjust, or terminate services at any time.
Article 3: Fees and Payment
Some services may incur charges as announced or based on a separate agreement signed by both parties.
Payment methods, deadlines, and currency are based on quotations, contracts, or website announcements.
If payment is not received by the due date, the Center may suspend all or part of the Services and terminate the contract.
Paid fees are generally non-refundable unless the Services cannot be delivered due to reasons attributable to the Center.
Users who request service upgrades or expansions shall pay the additional fees accordingly.
Article 4: Rules of Use
Users shall not use the Services for any illegal purposes, rights infringement, or activities that violate public order or morals.
Attacks (e.g., DDoS), hacking, malicious scanning, spamming, virus distribution, and other malicious acts are strictly prohibited.
Users are responsible for backing up their data and bear the risks and losses arising from data loss or corruption.
Users must comply with relevant laws and intellectual property regulations and shall not upload, store, or distribute unauthorized content.
The Center reserves the right to monitor and handle abnormal or potentially abusive behaviors to maintain security and resource management.
The Center may impose necessary resource limitations (e.g., CPU, memory, network bandwidth) to ensure overall system stability.
Article 5: Data Protection and Privacy
The Center protects users’ personal data in accordance with the Personal Data Protection Act and related regulations. Please refer to the Privacy Policy for details.
Users retain ownership and confidentiality obligations for their processed or stored data.
Stored data may only be accessed and operated by the PI and authorized members according to their privileges.
The Center only provides storage and computing platforms and does not guarantee data accuracy, completeness, or availability. Users should back up important data.
The Center does not guarantee permanent data retention and may delete data after service termination based on announced schedules. Users are responsible for backups.
Data stored via the Services will be hosted in Taiwan and managed in compliance with local laws and the Center’s security and privacy policies.
Article 6: Intellectual Property Rights
All content provided by the Center (including but not limited to system architecture, code, graphics, logos, etc.) is protected by intellectual property laws. Unauthorized use is prohibited.
Intellectual property of any results produced by the user remains with the user. However, if such results involve the Center’s technical staff or resources, IP ownership shall be governed by a separate contract or memorandum of understanding.
If a user is found to be infringing rights, the Center may terminate the Services and seek legal remedies for any damages.
Article 7: Information Security Incidents
Users must promptly report any suspected security incidents (e.g., data breaches, abnormal access, account compromise) to the Center.
Users shall cooperate with investigations, audits, and corrective actions and provide necessary records and explanations.
If a security incident is found to be caused by the user’s negligence or misconduct, the user shall bear all related damages and legal responsibilities.
While the Center implements security protections, it does not assume final responsibility for data loss or service disruptions caused by incidents.
Article 8: Service Interruptions and Disclaimer
The Center may suspend all or part of the Services under the following conditions without liability for damages:
- System maintenance, upgrades, or troubleshooting;
- Interruptions in third-party services (e.g., telecommunications, electricity);
- Force majeure (e.g., natural disasters, war, legal changes);
- User violations of these Terms or other agreements.
The Center shall not be held liable for direct or indirect losses resulting from service interruptions or data loss, except as required by law or otherwise agreed in contract.
Article 9: Termination and Account Removal
Users may request to terminate their account or stop using the Services at any time.
If a user violates these Terms, the Center may immediately revoke service access without a refund.
Upon account termination, the Center reserves the right to delete all stored user data without further notice.
Article 10: Amendments to Terms and Service Adjustments
The Center may revise these Terms from time to time. Revisions will be announced on the website without individual notifications.
Continued use of the Services after revisions constitutes acceptance of the updated Terms.
Article 11: SLA Precedence
If a Service Level Agreement (SLA) applies, the SLA shall take precedence over these Terms within its applicable scope.
Article 12: Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of China (Taiwan).
In the event of legal disputes, both parties agree that the Taipei District Court shall be the court of first instance.
Article 13: Language
If there is any inconsistency between the Chinese and English versions of these Terms, the Chinese version shall prevail.

Welcome to the DiCOS Member Website and its related services (hereinafter referred to as “the Service”) provided by Academia Sinica Grid Computing Center (hereinafter referred to as “the Center”). To protect your rights, please read the following registration and service usage terms (hereinafter referred to as “these Terms”) carefully. By clicking the “I Agree” button online, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
These Terms constitute a binding contract between you (either individually or on behalf of the legal entity you represent) and the Center. If you are accepting these Terms on behalf of a legal entity or organization, you confirm that you are duly authorized to do so and have the authority to bind that entity.
Article 1. Account Registration
Users must complete registration before using the Service and provide accurate information representing themselves or their affiliated organization.
Users are responsible for safeguarding their account credentials. In case of loss or suspected misuse, the Center must be notified immediately.
Accounts may not be transferred, loaned, or granted to others for use. Users are fully responsible for any actions performed under their account.
The Center reserves the right to request identity verification or additional information. Failure to cooperate may result in restricted access.
All account identity verifications are conducted by the Principal Investigator (PI) of the respective user group.
Article 2. Scope of Services
The Center offers services subject to operational conditions, including but not limited to high-performance computing resources, storage services, data processing, AI training platforms, and user management systems. The specific services are based on official announcements and are subject to change, addition, or termination at the Center’s discretion.
Article 3. Service Fees and Payment
Some services may require payment by the group’s PI, according to official announcements or separate contractual agreements.
Payment methods, due dates, and currency will be specified in quotations, contracts, or official announcements.
If the PI fails to pay on time, the Center may suspend part or all of the services and reserves the right to terminate the contract.
Payments are generally non-refundable unless the Center is at fault and fails to provide the service.
If the PI applies for service upgrades or expansions, any cost differences must be paid accordingly.
Article 4. Terms of Use
Users must not use the Service for illegal activities, infringement of third-party rights, or acts contrary to public order or moral standards.
The following behaviors are strictly prohibited: cyberattacks (e.g., DDoS), hacking, malicious scanning, spamming, virus distribution, etc.
Users are responsible for regularly backing up their data and bear the risk of loss or damage to their data.
Users must comply with applicable laws and intellectual property rights; unauthorized uploading, storing, or distributing copyrighted material is prohibited.
The Center may monitor and handle abnormal, abusive, or suspected misconduct to maintain system security and manage resources.
To ensure overall system stability, the Center may impose necessary resource limits (e.g., CPU, memory, bandwidth).
Article 5. Data Retention and Privacy
The Center protects users’ personal data in accordance with the Personal Data Protection Act and relevant laws. Please refer to the Privacy Policy for details.
Users retain ownership and responsibility for the confidentiality of the data they process or store.
Data stored through the Service may only be accessed or operated by the PI and authorized group members according to assigned permissions. Unauthorized access or modification is prohibited.
The Center only provides storage and computing platforms and does not guarantee the accuracy, completeness, or availability of user data. Users are responsible for backing up critical information.
The Center does not guarantee permanent data retention and may delete data after service termination in accordance with posted deadlines.
User data stored on the Service will be kept in Taiwan and managed in compliance with applicable laws and the Center’s cybersecurity and privacy policies.
Article 6. Intellectual Property
All content provided by the Center (including but not limited to system architecture, source code, visual designs, and logos) is protected under intellectual property laws and may not be used without authorization.
The intellectual property rights of outcomes generated by users through the Service belong to the original users. However, if developed with the Center’s technical support or resources, ownership must be separately agreed upon through contracts or memoranda of understanding.
In the case of infringement by a user, the Center reserves the right to suspend services and pursue legal remedies and damages.
Article 7. Information Security Incidents
Users must promptly report any suspected information security incidents (e.g., data leaks, unusual connections, account breaches) to the Center.
Users must cooperate fully in any investigations, audits, or remediation efforts by the Center and provide necessary records or explanations.
If the incident results from user negligence or violation, the user shall bear full legal and financial responsibility.
While the Center has implemented security measures in accordance with best practices, it cannot guarantee immunity from data loss or service disruption due to security incidents.
Article 8. Service Interruptions and Disclaimers
The Center may suspend all or part of the Service without liability under the following circumstances:
- System maintenance, upgrades, or issue resolution;
- Disruptions caused by third-party services (e.g., telecom, electricity);
- Force majeure (e.g., natural disasters, war, legal or policy changes);
- Violations of these Terms or other contractual obligations.
The Center is not liable for any direct or indirect loss resulting from service interruptions or data loss, unless otherwise required by law or stated in a separate contract.
Article 9. Termination and Account Removal
Users may request to terminate their accounts or stop using the Service at any time.
If users violate these Terms, the Center may immediately revoke their access without refund.
Upon account termination, the Center reserves the right to delete all user-stored data without further notice.
Article 10. Amendments and Service Adjustments
The Center may revise these Terms from time to time. Changes will be announced on the website without individual notifications.
Continued use of the Service after any revision constitutes acceptance of the updated Terms.
Article 11. Service Level Agreement (SLA)
If a separate Service Level Agreement (SLA) has been signed between the Center and the user, the SLA terms shall take precedence in interpreting relevant service matters.
Article 12. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of China (Taiwan).
In case of disputes, both parties agree that the Taipei District Court shall be the court of first instance.
Article 13. Language
If there is any inconsistency between the Chinese and English versions of these Terms, the Chinese version shall prevail.
